There are three main scenarios for ending your contract: Standard Termination, Automatic Expiry, and Immediate Withdrawal.
1. Standard Termination - Applies to Auto-Renewing Passes
This section applies primarily to the OPEN SAMOODNAWIALNY pass and the OPEN 12 PLUS pass after its initial 12-month commitment period has ended (when it converts to an auto-renewing contract).
| Pass Type | Termination Notice Period | Effective Date | How to Submit |
|---|---|---|---|
| OPEN SAMOODNAWIALNY (Auto-Renewing) | One full calendar month | The contract ends on the last day of the calendar month following the month in which the termination notice was received. | Via the Portal Klienta (Customer Portal) or the club's self-service Kiosk, or by submitting a written statement to the club's headquarters. |
Example: If your payment date is the 15th of the month, and you submit your notice on November 6th, 2025, the termination period starts on December 1st, 2025, and the contract ends on December 31st, 2025. You must pay the fee for December.
2. Termination of Commitment Passes (OPEN 12 PLUS)
The OPEN 12 PLUS pass is a contract for a fixed period (12 months).
- During the first 12 months: You generally cannot terminate the contract unless there is a valid, important reason defined in the regulations (see Point 4).
- End of 12-Month Period: The contract automatically converts to the OPEN SAMOODNAWIALNY (auto-renewing) contract unless you submit a statement declaring the contract ends. This statement must typically be submitted before the 12-month period expires.
3. Automatic Expiry (Basic & Half Open)
Passes purchased for a fixed, short duration (e.g., OPEN BASIC or HALF OPEN BASIC, or a one-month pass) generally terminate automatically:
- Action Required: None. The contract ends on the final day of the purchased period.
- Note: If you fail to pay for a pass on time, the club will usually restrict your access but the contractual obligation (if you are in a fixed contract) may continue until properly terminated.
4. Special Termination Rights and Immediate Withdrawal
| Circumstance | Policy |
|---|---|
| Withdrawal - Online Purchase | If you purchased your pass online, you have the right to withdraw from the contract without giving a reason within 14 days of the purchase date, as per Polish consumer law. You must submit a written statement to the club's address. |
| Termination for a Valid Reason | You may be able to terminate the contract earlier than the notice period if a valid reason exists, such as a long-term illness or permanent injury certified by a doctor that makes training permanently impossible until the end of the contract. Relocation is typically not considered a valid reason unless explicitly stated in your contract. |
| Club's Breach of Contract | You have the right to terminate the agreement immediately with a written notice if the club grossly and persistently violates the terms of the regulations. |
📄 How to Submit Your Termination Notice
Fitness Platinium provides multiple ways to submit a termination notice:
- Online via the Customer Portal or Kiosk: This is the most common and easiest method for auto-renewing passes.
- In Writing: Send a written, signed statement via registered mail bok@fitnessplatinium.pl to the headquarters address. This is the safest method as it provides proof of delivery date.
- Address: Smart Platinium sp. z o.o., ul. Juliusza Lea 116, 30-133 Kraków.
- Via Email: Some older regulations allowed email submission to bok@fitnessplatinium.pl, but the Customer Portal or registered mail are the most secure ways to ensure compliance with the required notice period.
Recommendation: Always consult your specific contract and the most current version of the Fitness Platinium regulations for the final, binding terms.
